Parties
This Distance Sales Agreement (“Agreement”) is entered into electronically between the Seller identified above and the Buyer who places an order through oguttarim.com and provides their name, contact, billing and delivery information during checkout.
Subject and Legal Basis
This Agreement governs the sale, payment and delivery of the products ordered by the Buyer and the rights and obligations of the parties under Turkish Consumer Protection Law No. 6502, the Turkish Distance Contracts Regulation and other applicable mandatory legislation.
The product name, essential characteristics, quantity, tax-inclusive price, discounts, shipping charge, payment method, delivery address and order total shown in the Order Summary and order confirmation form an integral part of this Agreement.
Product Information and Prices
Applicable information regarding ingredients, net quantity, allergens, storage conditions, origin and use-by/best-before dates is displayed on the relevant product page and/or product packaging. Unless expressly stated otherwise, website prices are retail prices inclusive of applicable taxes. The final amount payable is shown before the Buyer places an order carrying a payment obligation.
Payment
Payment is made by credit/debit card or any other method made available at checkout. Card transactions are processed through the secure infrastructure of the authorised bank or payment service provider. The Seller does not store the full card number or CVV. Instalment, interest and card campaign terms are determined by the relevant financial institution.
Formation and Electronic Records
Before placing the order, the Buyer is given the opportunity to review the Preliminary Information Form, this Agreement and the Order Summary. The Agreement is formed when the order reaches the Seller’s system and the payment/authorisation is completed. The Agreement and order records are made available by email, customer account or another durable medium and retained for the legally required period.
Delivery and Shipping
Orders are shipped within Türkiye via Aras Kargo to the address provided by the Buyer. The estimated delivery time is 2–5 business days from order/payment confirmation. Public holidays, campaign periods, remote areas, weather conditions and force majeure events may affect this estimate. The statutory maximum delivery period remains reserved.
Standard shipping is free for orders of TRY 2,000 or more. For orders below TRY 2,000, the shipping charge is displayed before checkout. The threshold is calculated on the product total after discounts.
The risk of loss or damage remains with the Seller until the product is delivered to the Buyer or a third party designated by the Buyer. If the Buyer independently selects a carrier other than one offered by the Seller, risk may pass when the product is handed to that carrier.
Inspection upon Delivery
The Buyer is advised to inspect the outer package at delivery and request a carrier damage report in the event of visible crushing, tearing, wetness or leakage. Failure to obtain such a report does not automatically eliminate the Buyer’s statutory rights in relation to defective goods.
Right of Withdrawal
Unless a statutory exception applies, a consumer may withdraw from the Agreement without giving any reason and without penalty within 14 days from the date on which the consumer or a third party designated by the consumer receives the product. Withdrawal may also be exercised before delivery.
The notice may be sent to info@oguttarim.com, oguttarim@hs01.kep.tr, the website return-request area or the Seller’s registered address in writing or by another durable medium. The consumer must return the product within 10 days after sending the notice, using the Aras Kargo return code provided by the Seller.
No return shipping charge is imposed where the specified Aras Kargo method is used. If the specified carrier has no branch at the consumer’s location, the Seller arranges collection without additional charge.
Subject to the statutory conditions, the Seller refunds the collected payments within 14 days after receiving the withdrawal notice, using the original payment method and without imposing a charge on the consumer. The bank’s posting period is outside the Seller’s control.
Exceptions to the Right of Withdrawal
- Goods liable to deteriorate or expire rapidly;
- Goods whose package, seal, tape or other protective element has been opened after delivery and which are unsuitable for return for health or hygiene reasons;
- Goods prepared to the consumer’s specifications or clearly personalised;
- Goods inseparably mixed with other items after delivery.
These exceptions do not restrict the consumer’s statutory rights where a product is defective, spoiled, damaged, incomplete, incorrectly supplied or does not have the promised characteristics.
Defective Goods
If a product is defective, spoiled, damaged, incomplete, incorrect or inconsistent with its advertised characteristics, the consumer retains the remedies granted by Turkish Consumer Protection Law No. 6502. Depending on the circumstances, the consumer may request rescission and refund, a proportionate price reduction, repair where possible, or replacement with a conforming product.
A product suspected of presenting a food-safety issue should not be consumed. The packaging, batch/lot number and date information should be retained and the Seller should be contacted with the order number and, where possible, photographs.
Impossibility of Performance
If supply or delivery becomes impossible, the Seller informs the Buyer in writing within three days after becoming aware of the situation and refunds all amounts collected within fourteen days after that notification. A product merely being out of stock does not, by itself, constitute impossibility of performance.
Force Majeure
Where natural disaster, war, epidemic, strike, transport interruption, public-authority decision, infrastructure failure or another event beyond reasonable control affects performance, the Buyer is informed without undue delay. The consumer’s mandatory rights remain unaffected.
Personal Data and Marketing
Personal data is processed for the purposes and on the legal grounds described in the KVKK Privacy Notice. Consent for marketing and commercial electronic communications is requested separately and is optional.
Complaints and Dispute Resolution
Requests and complaints may be submitted through the Seller’s contact channels. Depending on the value of the dispute and applicable monetary thresholds, consumers may apply to the competent Consumer Arbitration Committee or, where applicable, pursue mandatory mediation and the Consumer Court in Türkiye.
Effective Date
This Agreement enters into force when the Buyer electronically confirms the order carrying a payment obligation.
